Why Are Universities Liable for Sexual Assault?
Under Title IX, universities, colleges, and other educational institutions must take reasonable and adequate steps to protect students from sex-based discrimination, which includes sexual assault and abuse. If a student is sexually assaulted on campus, it is fair to argue that the university or college failed to uphold its obligations under Title IX, which can be interpreted as liability.
