Exactech Implant Device Attorneys

Representing Injured Clients Nationwide

The U.S. Food and Drug Administration (FDA) has issued multiple warnings about defective Exactech implant devices, which mostly include replacement systems for knees, ankles, and hips. A serious packaging issue put countless devices manufactured between 2004 and 2021 at risk of oxidation and significantly early device failure after implantation. If you think you have an affected or recalled Exactech implant, you should talk to your healthcare provider and the attorneys of Grewal Law PLLC, serving clients nationwide. You may have the option to use legal action to demand justice and compensation with our representation.

Defective Exactech joint replacement systems include the following:

  • Optetrak knee replacements
  • Logic knee replacements
  • Truliant knee replacements
  • Vantage total ankle replacements
  • Novation hip replacements
  • Acumatch hip replacements
  • MCS hip replacements

Talk to an Exactech recall attorney today. Even if you weren’t injured by a defective Exactech device, you could still have grounds for a claim. Call (888) 211-5798 or fill out an online contact form now.

Dangers of Defective Exactech Joint Replacements

According to the FDA, Exactech used the wrong type of packaging bags when producing and shipping many different types of joint replacement devices between 2004 and August 2021. The bags were not capable of creating an airproof seal. As the devices sat in storage, air gradually leaked into the bags and began the oxidation process within certain plastic (polyethylene) components of the joint replacement systems.

An oxidized Exactech joint replacement system creates a significant risk of:

  • Early and/or otherwise avoidable device damage
  • Total device failure
  • Fracturing within the device
  • New or worsening pain around the replaced joint
  • New or worsening bone loss around the replaced joint
  • Swelling or redness in the affected area
  • Pain while walking, standing, or lying down

Ultimately, if an Exactech hip, knee, or ankle device has become defective, revision surgery is highly likely. As with any surgical procedure, revision surgery to replace a defective device will carry its own risks and potential side effects, which unfairly puts the Exactech patient in harm’s way.

Is Your Exactech Device Defective?

You may have a defective Exactech joint replacement system if you have experienced:

  • New or worsening pain around the replaced joint
  • Inability to bear weight on the replaced joint
  • Grinding or grating noise when walking
  • Swelling or redness around the replaced joint
  • Instability or discomfort when walking or sitting
  • Signs of infection

If you have experienced any symptoms that might indicate a defective Exactech joint replacement device, please see a medical provider as soon as possible for proper medical care. You can also talk to your doctor or the surgeon who completed the implantation surgery to learn more about the exact device that was used.

Do You Have a Valid Exactech Lawsuit?

You might have a valid claim or lawsuit to file against Exactech even if you have not yet experienced adverse side effects or a total device failure. If the joint replacement system used during your surgery has been flagged for recall, then you likely have a claim.

Factors that could impact the legitimacy of your claim include the following and more:

  • What Exactech device was used during the joint replacement surgery.
  • When the joint replacement surgery occurred.
  • What signs of device failure you have experienced.
  • What injuries or disabilities you have suffered so far.
  • What treatments are available to help you recover if any.

Understanding your options will be much less stressful with the help of our legal team. We would be happy to help you figure out if you can file a claim against Exactech for selling an unsafely manufactured medical device.

Compensation in Exactech Recall Lawsuits

In your Exactech recall claim or lawsuit, we might be able to pursue damages related to:

  • Past and future medical treatment costs
  • Costs related to replacing the defective device
  • Lost wages
  • Lowered income earning capability (related to new disabilities)
  • Pain, suffering, and hardship

Our attorneys are well-versed in all types of legal actions, including individual lawsuits and those that are technically part of a larger mass tort, which is common for defective medical device cases. We can attempt to negotiate with Exactech’s attorneys and insurance companies to secure a settlement offer that fairly reflects your pain and losses. If no settlement is possible, we can also talk to you about advancing your case to court; we have trial attorneys ready to enter litigation when necessary, so no case is ever too tough for our team.

Can You Sue the Hospital, Too?

Exactech has been accused of selling joint replacement devices that became defective during transit and storage. Medical professionals and hospital groups were not aware of the issue when purchasing and using the devices during surgeries. Therefore, it is unlikely that you will be able to bring a claim against the hospital or surgeon who completed your Exactech joint replacement surgery.
